Appointment & Independent Contractor Status
- The installer is appointed as an independent contractor and not an employee.
- The installer is responsible for their own taxes, UIF, PAYE, insurance, transport, tools, and labour staff.
- No employment relationship is created through registration.
Scope of Work
The installer agrees to:
- Install solar systems according to company specifications
- Follow all electrical and safety regulations
- Complete installations professionally and safely
- Follow approved system designs and engineering specifications
- Perform commissioning and testing correctly
- Submit required installation documentation
Compliance Requirements
The installer must comply with:
- South African electrical regulations
- SANS standards
- NRS regulations
- Municipal requirements
- Occupational Health & Safety Act
- Manufacturer installation requirements
The installer must maintain:
- Valid Wireman’s License (where applicable)
- Valid electrical registration
- Valid COC authority where required
Quality Standards
The installer agrees that:
- All work must meet company quality standards
- The company may inspect any installation
- Defective workmanship must be corrected at the installer’s cost
- Repeated poor workmanship may lead to suspension or termination
Workmanship Warranty
- The installer provides a workmanship warranty (commonly 12–24 months)
- The installer remains liable for installation-related defects
- Manufacturer warranties remain separate from workmanship warranties
Health & Safety
The installer is fully responsible for:
- Site safety
- PPE compliance
- Working-at-height procedures
- Safety of staff and subcontractors
- Safe handling of batteries and electrical equipment
The company is not liable for:
- Installer injuries
- Staff injuries
- Damages caused by unsafe work practices
Insurance Requirements
The installer must maintain:
- Public liability insurance
- Workers compensation/COIDA compliance
- Vehicle insurance
- Tool and equipment insurance
Optional but recommended:
- Professional indemnity insurance
Installer Responsibilities
The installer must:
- Arrive on time
- Maintain professional conduct
- Treat clients respectfully
- Keep sites clean
- Protect customer property
- Use approved materials only
- Report issues immediately
Non-Solicitation / Client Protection
The installer may not:
- Circumvent the company and approach the finance source directly – this will lead to immediate removal and lifetime band from Sunscribe or any finance models WOSWP my offer in the future
- Sell directly to company clients
- Solicit future work from company customers
- Share company pricing or business information
This restriction usually applies:
- During active registration
- For 12–24 months after termination
Confidentiality
The installer agrees not to disclose:
- Pricing structures
- Customer information
- System designs
- Company procedures
- Supplier pricing
- Business strategies
Payment Terms
Clearly define:
- Installation rates
- Payment milestones
- Required documentation before payment
- Payment timelines
- Penalties for incomplete work
- Retention amounts (if applicable)
Example:
- Payment only released after QA approval and customer sign-off.
Equipment Responsibility
The installer is responsible for:
- Safe handling of company equipment
- Loss or theft due to negligence
- Damage caused during installation
Installation Documentation
The installer must submit:
- Photos
- Commissioning reports
- COC documentation
- Serial numbers
- Client sign-off forms
- Testing results
No documentation = no payment.
Branding & Conduct
The installer:
- May not misrepresent the company
- May not make false promises to customers
- Must wear approved PPE/uniform if required
- Must maintain professional behaviour
Breach & Termination
The company may suspend or terminate registration for:
- Unsafe installations
- Fraud
- Theft
- Poor workmanship
- Customer complaints
- Non-compliance
- Damage to company reputation
Termination can be immediate for serious misconduct.
Liability Limitation
The company is not liable for:
- Installer business losses
- Injuries to installer staff
- Third-party claims caused by installer negligence
- Damage resulting from incorrect installation practices
Dispute Resolution
Include:
- Mediation process
- Arbitration clause
- Governing law (South African law)
- Jurisdiction
POPIA Compliance
Installers must:
- Protect customer personal information
- Not share customer data
- Comply with POPIA requirements

Because you are running a subscription finance model, add these specifically:
Asset Ownership
- All solar equipment remains company property unless otherwise agreed in writing.
- Installers may not remove, tamper with, or substitute equipment.
Subscription System Standards
- Installers must follow exact approved specifications.
- No substitutions allowed without written approval.
- Incorrect installations affecting system performance may result in financial penalties.
Remote Monitoring Compliance
- Installer must ensure monitoring systems are operational before sign-off.
- Internet connectivity and inverter communication must be tested.
